OFFICIAL RULES (2026)
1. SPONSOR
The Bits $4,999 Sweepstakes (the "Sweepstakes") is sponsored by Bits Card, Inc., a Delaware corporation ("Sponsor," "Bits," "we," "us," or "our").
This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta, X (formerly Twitter), or any other platform used in connection with its promotion.
2. ELIGIBILITY
Open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry.
Void where prohibited by law.
Not eligible:
- Employees, officers, directors, members, managers, agents, and representatives of Sponsor;
- Sponsor's affiliates, subsidiaries, advertising or promotion agencies;
- Immediate family members (spouse, parent, child, sibling) or household members of any of the foregoing.
Sponsor reserves the right to verify eligibility at any time.
3. ENTRY PERIOD
The Sweepstakes begins February 1, 2026 at 12:00 AM Eastern Time ("ET") and ends immediately upon the receipt of ten thousand (10,000) unique eligible base entries (the "Entry Period").
Clarifications:
- The 10,000-entry threshold applies only to unique base entries (one per individual).
- Referral entries do not count toward the 10,000 cap.
- Duplicate or invalid entries do not increase the count.
- Sponsor's database records shall control for purposes of determining when 10,000 valid base entries have been received.
Sponsor reserves the right to publicly announce the close of the Entry Period.
4. HOW TO ENTER
No purchase necessary. A purchase will not increase your chances of winning.
To enter, submit a valid email address through the official Sweepstakes entry form during the Entry Period.
Limit one (1) base entry per person and per email address.
Participants may not:
- Use multiple identities or email addresses;
- Submit entries on behalf of another person;
- Use automated systems, bots, scripts, macros, or similar methods;
- Attempt to manipulate or interfere with the entry process.
Sponsor reserves the right to disqualify any participant who violates these rules or attempts to circumvent entry limits.
5. REFERRAL ENTRIES (MEXICO PRIZE ONLY)
After submitting a valid base entry, participants may receive a referral link via email.
For each new individual who: (1) uses the referral link, and (2) submits a valid base entry during the Entry Period, the referring participant will receive one (1) additional entry into the Mexico Prize drawing.
Important:
- Referral entries apply solely to the Mexico Prize drawing.
- Referral entries do not increase eligibility for, or share of, the Cash Pool.
- Referral entries do not count toward the 10,000 base entry cap.
- Referral entries are unlimited.
- Sponsor reserves the right to void referral credits resulting from fraudulent, automated, disposable, duplicate, or bad-faith activity. Sponsor's determinations are final and binding.
6. PRIZES
A. Mexico Trip Prize
One (1) winner will receive a 7-day / 6-night all-inclusive trip to Mexico. Maximum Approximate Retail Value ("ARV"): $2,499 USD.
Trip includes:
- Round-trip economy airfare (if applicable),
- Standard double-occupancy accommodations,
- Standard meals and beverages,
- Standard resort amenities.
ARV Cap: $2,499 is a strict maximum. If selected travel components exceed the ARV, winner must select alternatives within ARV or pay the difference. Unused portions are forfeited and have no cash value. Trip must be booked within twelve (12) months of prize acceptance.
B. $2,500 Cash Pool
A guaranteed total of $2,500 USD will be distributed equally among all eligible base entrants except the confirmed Mexico Prize winner.
Calculation: $2,500 ÷ total number of eligible base entrants (excluding the Mexico Prize winner). Payments will be rounded down to the nearest cent. No minimum payout applies. The Mexico Prize winner is not eligible to receive any portion of the Cash Pool.
7. MEXICO PRIZE CONDITIONS
7.1 Non-Transferability & Travel Window
The Mexico Prize is non-transferable. Failure to travel within the permitted twelve (12) month window results in forfeiture. No cash alternative or substitute compensation will be provided.
7.2 Trip Disruptions & Partial Unavailability
If any component of the trip becomes unavailable due to airline delays, supplier cancellations, weather, or operational issues outside Sponsor's control: Sponsor may substitute a comparable component within the ARV; Sponsor is not obligated to provide upgrades or cover costs beyond the ARV; If substitution is not reasonably possible, the affected portion may be forfeited without liability. This section does not apply to events covered under Section 13 (Force Majeure).
7.3 Passports, Visas & Documentation
Winner and guest are solely responsible for obtaining valid passports, required visas, and any entry or exit documentation. Failure to meet travel requirements constitutes forfeiture.
7.4 Health, Medical & Special Needs
Sponsor: Does not provide medical care, evacuation, or repatriation; Does not guarantee special accommodations or dietary needs; Makes no representations regarding health or safety conditions. Travel insurance is optional but strongly recommended.
7.5 Conduct, Damages & Indemnification
Winner is responsible for all damages or charges incurred by winner or guest; property damage; policy violations. Winner agrees to indemnify Sponsor for claims arising from such conduct. Sponsor may require a valid credit card at check-in.
7.6 Alcohol & Legal Compliance
Winner and guest must comply with all destination laws. Alcohol consumption is at winner's own risk. Sponsor bears no responsibility for violations.
7.7 Third-Party Service Providers
All airlines, hotels, transportation providers, and other travel or service providers involved in the Mexico Prize are independent third-party providers and are not employees, agents, or representatives of Sponsor. Sponsor is not responsible for the acts, omissions, or performance of such third parties.
7.8 Mexico Prize Limitation of Liability
Sponsor's total liability relating specifically to the Mexico Prize shall not exceed the ARV of $2,499. Sponsor is not liable for: personal injury; illness; travel disruptions; acts of third parties; alcohol-related incidents. Participation is at winner's own risk.
7.9 Publicity Rights
By accepting the Mexico Prize, winner grants Sponsor the right to use first name, last initial, and general location for promotional purposes unless winner opts out in writing within five (5) days of prize acceptance. Opt-out does not affect prize eligibility.
8. WINNER SELECTION
The Mexico Prize winner will be selected in a random drawing conducted using a computer-generated randomization process. The drawing will occur within five (5) business days after the Entry Period closes. Odds of winning depend on the total number of eligible entries received, including referral entries.
9. WINNER NOTIFICATION
The potential Mexico Prize winner will be notified via email. The selected winner must respond within five (5) calendar days of notification. Failure to respond within five (5) days may result in forfeiture, and Sponsor may select an alternate winner. Sponsor reserves the right to verify identity and eligibility and may require an affidavit of eligibility and liability/publicity release where permitted by law.
10. CASH POOL DISTRIBUTION
Cash Pool payments will be distributed during the calendar month following confirmation of the Mexico Prize winner. Payments will be issued via a digital payment method selected by Sponsor (e.g., PayPal, Venmo, prepaid digital card, or similar electronic method delivered via email). Participants are responsible for providing accurate payment information. Sponsor is not responsible for failed or undeliverable payments due to incorrect, incomplete, restricted, or outdated information. Unclaimed payments may be forfeited.
11. TAXES
The Mexico Prize winner is solely responsible for all applicable federal, state, and local taxes. Sponsor may issue IRS Form 1099-MISC as required by law. Cash Pool recipients are responsible for any required tax reporting.
12. MARKETING COMMUNICATIONS
By entering the Sweepstakes, participants agree that they may receive promotional and marketing communications from Sponsor. Participants may unsubscribe at any time by emailing hello@getbits.app with a request to unsubscribe. Unsubscribing from marketing communications does not affect Sweepstakes eligibility. All communications will comply with applicable law, including the CAN-SPAM Act.
13. PRIVACY
Information collected in connection with this Sweepstakes is subject to Sponsor's Privacy Policy, available at /privacy.
By entering the Sweepstakes, participants acknowledge that they have read and understand the Privacy Policy and consent to the collection, use, disclosure, and processing of personal information as described therein. Without limiting the foregoing, Sponsor may use personal information for purposes of: administering the Sweepstakes; verifying eligibility; selecting and contacting winners; preventing fraud or abuse; distributing prizes; sending marketing communications as described in Section 11. In the event of any conflict between these Official Rules and the Privacy Policy regarding Sweepstakes-specific matters, these Official Rules shall control.
14. FORCE MAJEURE
Sponsor shall not be liable for delay, suspension, modification, or cancellation of the Sweepstakes or any prize component due to causes beyond Sponsor's reasonable control, including but not limited to: natural disasters; severe weather; government orders or regulatory actions; court orders or injunctions; labor disputes; civil unrest; pandemics; cyberattacks; technical failures; airline shutdowns; fraud; payment processor disruptions. Sponsor may cancel, suspend, or modify the Sweepstakes without liability if it cannot operate as planned.
15. RELEASE & LIMITATION OF LIABILITY
By participating, entrants release and hold harmless Sponsor from any claims arising out of: participation in the Sweepstakes; acceptance, use, or misuse of any prize; travel-related risks; technical failures; acts or omissions of third parties. Sponsor's total aggregate liability shall not exceed $4,999 USD. In no event shall Sponsor be liable for indirect, incidental, special, consequential, or punitive damages.
16. INDEMNIFICATION
Participants agree to indemnify, defend, and hold harmless Sponsor from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: violation of these Official Rules; fraudulent or unlawful conduct; misuse of any prize; breach of any representation made by participant.
17. NO INJUNCTIVE OR EQUITABLE RELIEF
To the fullest extent permitted by law, participants waive any right to seek injunctive or equitable relief that would interfere with or delay the operation of the Sweepstakes or Sponsor's business. Participant's sole remedy shall be monetary damages subject to the limitations set forth herein. If any court or authority issues an order affecting the Sweepstakes, Sponsor shall not be liable for resulting delay, modification, suspension, or cancellation.
18. ARBITRATION & CLASS ACTION WAIVER
Except where prohibited by law: All disputes shall be resolved exclusively through binding individual arbitration in Delaware under the Federal Arbitration Act. No class actions permitted. No jury trials permitted. Claims must be brought individually. Damages limited to actual out-of-pocket losses.
19. ELECTRONIC CONSENT
By submitting an entry electronically, participant agrees that: electronic submission constitutes legally binding acceptance of these Official Rules; electronic records satisfy any writing requirement.
20. SEVERABILITY
If any provision of these Official Rules is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
21. ENTIRE AGREEMENT; NO RELIANCE
These Official Rules constitute the entire agreement between Sponsor and participant relating to the Sweepstakes. Participants acknowledge they have not relied on any statement or representation not expressly set forth herein, including promotional materials or social media posts.
22. SURVIVAL
Provisions relating to arbitration, limitation of liability, indemnification, governing law, marketing communications, and dispute resolution shall survive completion or termination of the Sweepstakes.
23. GOVERNING LAW
This Sweepstakes is governed by the laws of the State of Delaware. Where court action is permitted, exclusive jurisdiction shall lie in Delaware.
